ARTICLE 1: APPLICABILITY
Each order constitutes acceptance by the buyer of the general terms and conditions, which form an integral part of the agreement, to the exclusion of all other general or special terms and conditions originating from the buyer, unless expressly agreed otherwise in writing.
ARTICLE 2: PAYMENT
Payment can be made using the following options: mobile QR code payments or bank transfer. Any inaccuracies in the invoicing must be reported to us immediately by the customer so that we can correct them. If you choose to pay by bank transfer, it may take a few days for us to receive your payment. Orders will only be shipped once we have effectively received payment.
ARTICLE 3: DELIVERY
Products are only delivered in countries for which the website allows delivery. Products are delivered as soon as possible after payment. Incorrectly provided delivery addresses are entirely the responsibility of the buyer and may lead to additional costs. Unless otherwise agreed, prices do not include the transport and delivery of the goods to the buyer. The costs of transport and delivery are stated separately. The stated delivery times are not binding, but are purely indicative. A delay in delivery can therefore never lead to the cancellation of the purchase or the payment of compensation to the buyer. We have the right to make partial deliveries. In case of non-delivery of the goods, any sums paid by the buyer will be refunded without interest or other compensation.
Please check the entered address details carefully; packages returned to us will be charged to the buyer. This amount is €7.50.
ARTICLE 4: PRICE
Our stated sales prices on the website always include VAT, but exclude delivery costs, which are determined during the purchase process and communicated before the final settlement. The final total cost will be settled in Euro and explicitly and clearly stated at the end of the purchase process, before the user definitively confirms their purchase. Some decorative elements used for the presentation of the goods are not supplied with the chosen product.
ARTICLE 5: OWNERSHIP
As long as the article price, including all charges and shipping costs, has not been paid in full, the articles remain our property. In case of non-payment, we reserve the right to reclaim the goods, by right and at the buyer's expense.
ARTICLE 6: CONSEQUENCES OF NON-PAYMENT
Without prejudice to the exercise of other rights we possess, in case of non-payment or late payment, the customer shall, from the date of default and without prior notice, owe interest of 10% per annum on the unpaid amount. Furthermore, the customer shall, by operation of law and without prior notice, owe a fixed compensation of 10% on the amount concerned, with a minimum of 25 euros per invoice. Notwithstanding the foregoing, we reserve the right to reclaim the articles that have not been (fully) paid for.
ARTICLE 7: DAMAGE
Any visible damage and/or qualitative defect of an article or other defect in the delivery must be reported immediately, failing which any right will be forfeited, to customer service within 24 hours of delivery of the product.
ARTICLE 8: WARRANTY
Legal warranty (for consumers only): Pursuant to the law of 21 September 2004 concerning the protection of consumers when selling consumer goods, the consumer has legal rights. Every article is subject to the legal warranty from the date of purchase by (or delivery to, if applicable) the first owner. Any commercial warranty does not affect these rights.
General: To claim under the warranty, the customer must present the order confirmation or till receipt and proof of payment. For articles purchased online and delivered to the customer at the address indicated by them, the customer must first contact customer service, after which the customer must return the article at their own expense. It is possible to exchange or have articles repaired via the workshop. The repair of an article does not entitle to a refund. Any defect must be reported within 14 days of its discovery. After this period, all rights to free repair or replacement expire. The (commercial and/or legal) warranty never applies to defects arising from careless use, accidents, abnormal or incorrect use, self-made modifications to the article, poor maintenance or normal wear and tear. It also does not apply to articles with a shorter lifespan, or wear and tear articles. The warranty is not transferable.
ARTICLE 9: CUSTOMER SERVICE
Customer service can be reached via email at mail
ARTICLE 10: SHIPPING
Orders will be shipped once payment is received. National deliveries will take an average of 1 to 5 working days. Custom-made items have a longer delivery time. International deliveries depend on the country of destination. Either shipping by standard mail (€3.95) which is not traceable, or shipping with tracking (€6.95) which is traceable. If shipping by standard mail (€3.95) is chosen, the responsibility and risk are entirely with the customer. Shipping costs are FREE for orders from €80 WITHIN BELGIUM.
ARTICLE 11: GIFT VOUCHERS
Gift vouchers can also be purchased on our website. These remain valid for 12 months from the date of issue. If the amount of the purchases exceeds the value of the voucher, the difference will be paid by the customer according to the usual payment method. No voucher can be refunded in full or in part. Only 1 gift voucher can be used per order; the balance of the gift voucher cannot be used for shipping.
The voucher must also be spent in one go; if the value of the voucher is greater than the purchase, please contact us at hello@maison-cachet.be.
